Nemecek & Cole Managing Partner Jonathan Cole appeared before the United States Supreme Court on behalf of Johnnie L. Cochran, Jr.
On March 23, 2005, the United States Supreme Court heard oral argument in the First Amendment case of Ulysses S. Tory v. Johnnie L. Cochran, Jr. The question presented to the Court was as follows:
"Whether a permanent injunction as a remedy in a defamation action, preventing all future speech about an admitted public figure, violates the First Amendment.”
One week after oral argument, long-time Nemecek & Cole client and highly-respected attorney Johnnie Cochran passed away. The effect of Mr. Cochran's untimely passing on the dispute before the United States Supreme Court is unclear.
